Google execs sentenced to prison in privacy scandal - has the whole world gone crazy?

Earlier today, an Italian judge decided three Google executives were at fault over the submission of an offensive video on Google Video Italia. The alleged violation of privacy for an autistic child seen beaten in the video was placed at the feet of Google as a content provider, and six months of (assuredly commuted) jailtime has been handed out as a result. As you can imagine, this has some far reaching repercussions on the internet as a whole.

The horrendous video was first uploaded in 2006, and quickly removed after it was flagged as offensive content. In it, several delinquent students are seen bullying and beating a student with Down Syndrome. Despite the executives having nothing to do with the video besides it appearing on their site, a Down Syndrome support group called Vivi Down protested the fact that it had even been allowed to be uploaded in the first place. A long investigation followed, the result of which is a guilty verdict for Google.

Italian law allows Internet Service Providers to exist free from legal obligations to people who use their service, but internet content providers are held liable. With Google Video, Google sees itself as providing a service and falling into the first category. The ruling from Judge Oscar Magi sentences them because it judges them to be in the latter one.

To sum up Google's reaction in a sentence, after they picked up their jaws from the floor, goes something like this: "the Web as we know it will cease to exist [with the passing of this ruling]". Seriously, that's a quote from a response in their blog. If Google Video is responsible for all content it "publishes," then so too is YouTube, Blogger, Facebook and Twitter - this ruling would mean pretty much the end of social content in Italy.

Reading this today, I couldn't help but think of similar stories of individual countries regulating their internet in places like Australia, France, and of course China. Continuously, I find myself waffling back and forth between accepting that countries should be allowed to regular their own internet how they please, and wondering if the whole world has just gone crazy, and nobody remembers the rules anymore. The internet has opened up global doors for good and for bad - personally, I think the former far outweighs the latter - and all these oddball rules mean more fracturing and more splintering. I mean, is the goal to leave our children a world where there is a different "internet" for every country, instead of the one glorious one we have today? If the owners of, say, the next Wikipedia happen to be born in Italy, will they never bother to bring their idea to light, because they're worried about violating their country's version of the internet?

For now anyway, Google will be appealing within the EU.

    It seems that Google is withdraw its services from Italy. I do not understand that law I mean when internet service providers are free her of any legal obligations then why not internet content providers like Google where content is uploaded by users and not Google. In this case, Google can be termed as internet service provider if they have to follow the law. I think Italy needs to think over these and also whether they want the people of Italy to take advantage of web 2.0 unlike China cheap VPS

What the Italians are effectively saying is that all websites should be static one-way affairs with no interaction.     I'm mixed on this issue. I can understand people being upset that this video even made it on Google, but they did take it down soon after. It's tough to regulate every video and it takes the community's help in making sure that a video like this doesn't stay long on the web. It just seems a little harsh for having nothing involved and doing the best they can to have it removed immediately. The person who published it should be at fault.

    Wow. What a case. Itâs a wonder that there havenât been more like it, but then, as you mentioned, if everyone was sued for everything âbadâ that was posted on the internet, there would be no youtube, facebook, twitter, etc. By trying to crack down on social networking youâre destroying peopleâs individual rights (though this is subjective depending on the country).

    Seriously, that's a quote from a response in their blog. If Google Video is responsible for all content it "publishes," then so too is YouTube, Blogger, Facebook and Twitter - this ruling would mean pretty much the end of social content in Italy.

    It seems Google is going to withdraw its services from Italy like what happened in China. I do not understand that law I mean when internet service providers are free her of any legal obligations then why not internet content providers like google where content is uploaded by users and not google. In this case, google can be termed as internet service provider if they have to follow the law. There are millions of videos uploaded to youtube so they cannot really check each video before making it live. I think Italy needs to think over these and also whether they want the people of Italy to take advantage of web 2.0 unlike China.
